§ 115.01. Definitions.

  • For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

    Intoxicating liquor means alcohol, brandy, whiskey, rum, gin, beer, ale, porter and wine, and in addition thereto any spirituous, vinous, malt or fermented beverages, liquids and compounds, whether medicated, proprietary, patented or not, and by whatever name called, containing 0.5 percent or more of alcohol by volume, which are fit for use for beverage purposes.

    Malt beverage means beer, lager, malt liquor, ale, porter and any other brewed or fermented beverage containing at least 0.5 percent, and not more than six percent alcohol by volume.

    Town property.

    (1)

    Any real property owned or occupied by the town, including, but not limited to, parking lots, streets, alleys, roads, sidewalks, boardwalk areas, docks, buildings, easement areas, lots or parcels of real property, and similar real property or any interest therein owned or occupied by the town without exception as to the methods or means by which the town may possess or occupy the same.

    (2)

    The public parking lots, town docks, boardwalks, sidewalks, easement areas and buildings and other real property owned and/or occupied by the town within the area bordered on the west by Moore Street, on the north by Ann Street, on the east by Marsh Street, and on the south by a line 150 yards south of and parallel to the south line of Front Street, is expressly included within this definition.

    (3)

    For purposes of this chapter, the term town property shall not include any real property owned or occupied by the town which joins a restaurant or establishment holding an on-premises ABC permit and which area the town has conveyed by easement or lease to a person for use by the restaurant or business establishment adjacent thereto.

    Unfortified wine means wine that has an alcoholic content produced only by natural fermentation or by the addition of pure cane, beet or dextrose sugar, and that has an alcoholic content of not less than six percent and not more than 17 percent alcohol by volume.
