§ 70.05. Procedure for amending the schedule of traffic regulations.

  • (A)

    Amendments; right. The Town Council shall have the right to amend the Schedule of Traffic Regulations from time to time as it deems appropriate.

    (B)

    Traffic Administrators. Subject to the limit specified in subsection (D) below, the Director of Public Works and Chief of Police (collectively "Traffic Administrators"), by written instrument signed by both and filed with the Town Clerk, are authorized to amend the Schedule of Traffic Regulations in any of the following areas:

    (1)

    Turning restrictions. The Traffic Administrators may designate intersections at which drivers of vehicles shall not make a right, left or U-turn. The making of turns may be prohibited between certain hours of any day and permitted at other hours, which shall be plainly indicated on the signs or the signs may be removed when the turns are permitted.

    (2)

    One-way streets and alleys. The Traffic Administrators may designate one-way streets or alleys.

    (3)

    Stop and yield requirements. The Traffic Administrators may designate which lanes of traffic are required to stop, or yield the right-of-way, at intersections.

    (4)

    Parking on public streets. The Traffic Administrators may regulate and restrict parking in public streets, public street rights-of-way, public alleys, and public parking areas. Such restrictions may completely prohibit parking or may limit the hours of parking. Such regulations may also restrict standing of vehicles, which, for purposes of this section, means an occupied vehicle with its engine running which is stopped longer than necessary to obey traffic regulations.

    (C)

    Designation of fire lanes. Subject to the limit specified in subsection (D) below, the Chief of the Fire Department by written instrument signed and filed with the Town Clerk is authorized to amend the Schedule of Traffic Regulations regarding traffic and parking in fire lanes as follows:

    (1)

    Fire lanes may be established in privately owned but public vehicular areas of shopping centers, and multifamily complexes, or any other private parking area which is open to the public.

    (2)

    Fire lanes may be designated on any surface, road, alley, driveway or roadway generally used for the movement or parking of motor vehicles, when the parking of motor vehicles or other obstructions in that area would interfere with the speed and efficiency of fire fighting and emergency personnel or the proper ingress and egress of emergency vehicles and equipment.

    (3)

    Areas designated as fire lanes shall be clearly marked, with yellow or another suitable color of paint, with the words "No Parking, Fire Lane," and the boundaries, borders, or curbs shall be clearly visible. Such markings will be installed by the owner of such property.

    (D)

    Limitation of authority. Neither the Traffic Administrators nor Chief of the Fire Department shall have authority to amend any traffic regulation adopted by the Town Council after October 6, 2008.
